Below is a video created by DonHarrold.net. (Hat tip to iTuliper lb (http://www.itulip.com/forums/member.php?u=2386) for finding it.) In it Don shows a classic Jim Cramer switcheroo. First he says one thing, then the exact opposite with equal conviction a few months later after the market has turned against him without admitting that he's changed his position 180 degrees. We noted this tendency way back in 2000 and gave Jim Cramer an award (http://www.itulip.com/awards.htm) for his not so deft switching from bull to bear after his audience got their asses handed to them following his bullish advice into the 2001 bear market. He did it all over again with the housing bubble. We created a video to show it and posted it to YouTube.com.

But it didn't stay up for long. Below is the letter we received from TheSteet.com's General Counsel Teresa Santos. Apparently TheStreet.com doesn't like it when web sites use clips of their show to reveal their boy Jim's – how shall we say – "inconsistency." TheStreet.com doesn't mind sites using clips of TheStreet.com that are complimentary of Jim, as we have done on occasion. It's only the critical videos that violate TheStreet.com's copyright.

In the unanimous opinion of dozens of iTulipers polled, including a few lawyers, the video constituted fair use and iTulipers urged us to take them on, but our advisers convinced us that we have better things to do than spend hundreds of thousands of dollars and who knows how many hours of our time fighting TheStreet.com over our fair use rights, so we made the video unavailable as TheStreet.com requested.

Good thing.

The same ought to be said about Cramer. Why waste one's time watching this show, even if it would be to find inconsistencies?

A better thing to do IMHO would be to advice members not to watch this show as it is a total waste of time.

Parody is our way of doing that. You can tell folks not to watch Cramer or you can show them the real Cramer and let them decide for themselves. Problem is, try to show the real Cramer and you're going to get threatened with a law suit. That's the way our corrupt system works.

curious... why go after itulip but not this guy don? they got a better case with don. itulip is a macro economics journal not a stock picker site so the fair use argument holds... but he's a stock trade site... competitive. that'd be their claim, using thestreet.com content to advertise a competitive service. right?

In the future you could do re-enactments using his exact words. You can have fun with it then, put them both in bikinis, have them played by children, drag queens, animals, etc. You could even have Michael Richards play "Cramer". On second thought, no.

Would using the real audio with animation or still images make a difference? Robert Smigel does it on Saturday night live, but that is purely parody and entertainment.

No kidding we've seriously looked into doing this, have an actor, producer, post production, etc., all lined up. We even have a name for the show: "Sad Money."

We believe it was taken down by YouTube today Feb. 18. If so then the Feb. 18th contenders for the gold are: robdidomenico, mimbulus, and DemonD.

The creator of the video Don Harrold promised to tell us the exact date and time. We have contacted Don and await his reply. The winner will be announced shortly.
